Terms of Service

By accessing or using PitchedOps ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms. If you do not agree, do not use the Service.

PitchedOps is offered on a subscription basis. Plans and pricing are available at pitchedops.com/pricing. All fees are in USD and are non-refundable except as required by law or as described in our refund policy.

Subscriptions auto-renew monthly or annually. You may cancel at any time; cancellation takes effect at the end of your current billing period. Trial periods are subject to conversion to paid plans at the rates in effect at the time.

We may change prices with 30 days notice to your registered email address.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other tenants' data
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to transmit malware or harmful code
• Resell or sublicense the Service without our written consent
• Use the Service to store or process data you don't have rights to
• Abuse the API in ways that degrade service for others

You retain ownership of all data you submit to PitchedOps. You grant us a limited license to process your data solely to provide the Service. We do not claim ownership of your business data, customer lists, or operational information. You are responsible for ensuring you have the rights to submit data to our platform (e.g., that syncing customer records complies with your CRM's terms and applicable privacy laws).

PitchedOps integrates with third-party services (Pipedrive, QuickBooks Online, Google, etc.). Your use of those integrations is subject to the third parties' own terms. We are not responsible for changes those providers make to their APIs or for outages on their platforms.

The PitchedOps platform, including all software, algorithms, designs, and content created by us, is owned by PitchedOps, Inc. and protected by copyright and other intellectual property laws. Nothing in these Terms transfers any of our intellectual property to you.

We target 99.5% monthly uptime. We will notify you of planned maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our reasonable control (infrastructure providers, internet failures, acts of nature, etc.). Scheduled maintenance windows are excluded from uptime calculations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PITCHEDOPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, OR BUSINESS INTERRUPTION. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRIOR TO THE CLAIM.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED. FINANCIAL AND LEGAL DATA PROVIDED BY THE SERVICE IS FOR OPERATIONAL GUIDANCE ONLY — CONSULT QUALIFIED PROFESSIONALS FOR LEGAL AND FINANCIAL DECISIONS.

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately for violation of these Terms, non-payment, or if required by law. Upon termination, your right to use the Service ceases. We will retain your data for 90 days after termination for account recovery, then delete it per our retention policy.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Broward County, Florida. You waive any objection to such jurisdiction and venue.

We may modify these Terms with 30 days notice for material changes. Continued use of the Service after the effective date constitutes acceptance. We will email registered users about material changes.
